Article 1 — Purpose and Scope
These General Terms and Conditions of Sale ("GTC") govern the sales of products made on the TravelShield website (the "Site"), operated by [Corporate name / Business name], [legal form] with a capital of [share capital if applicable], registered with the Trade and Companies Register of [city] under number [SIREN/SIRET], whose registered office is located at [full address of registered office] (hereinafter "the Seller").
Any order placed on the Site implies the unreserved acceptance of these GTC by the customer ("the Customer"), who acknowledges having read them before validating their order.
Article 2 — Products
The products offered for sale are those listed on the Site on the day of consultation by the Customer, within the limits of available stock. Each product is presented with a description and essential characteristics as precise as possible. In case of unavailability after order, the Customer is informed as soon as possible and is refunded the totality of the sums paid, without undue delay.
Article 3 — Prices
Prices are indicated in euros (€), all taxes included (TTC). They do not include delivery costs, which are specified and displayed separately before the final validation of the order. The Seller reserves the right to modify its prices at any time, it being understood that the applicable price is that in effect at the time of order validation.
Article 4 — Order
The Customer selects the products of their choice, adds them to their cart, then validates their order after checking the details and the total price, including delivery costs. The order is only final after payment confirmation. A summary order confirmation email is sent to the Customer at the address indicated when placing the order.
The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order, or in case of clear suspicion of fraud.
Article 5 — Payment Methods
Payment is made online, at the time of order, by the payment methods offered on the Site. Transactions are secured by Shopify's payment infrastructure. The Seller never has access to the Customer's full bank details.
Article 6 — Delivery
Delivery methods, times, and costs are detailed in the Site's Delivery Policy, accessible from the footer. The Customer is invited to read it before finalizing their order.
Article 7 — Right of Withdrawal
In accordance with articles L. 221-18 et seq. of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay penalties, with the exception, where applicable, of return costs. Article 8 — Legal Guarantees
Regardless of any commercial warranty possibly offered by the Seller, the latter remains bound by the following legal guarantees:
- The legal guarantee of conformity (articles L. 217-3 et seq. of the Consumer Code), for two years from the delivery of the goods for new goods;
- The legal guarantee against hidden defects (articles 1641 et seq. of the Civil Code), for two years from the discovery of the defect.
These guarantees allow the Customer to request the repair or replacement of the non-compliant or defective product, or, failing that, its total or partial refund, at no cost to them.
Article 9 — Liability
The Seller cannot be held responsible for the non-performance of the contract in case of stock shortage or unavailability of the product, force majeure, disruption or total or partial strike, notably of postal services and transport means, or in case of misuse of the products by the Customer, not in accordance with the provided notices and instructions.
Article 10 — Intellectual Property
All elements of the Site (texts, visuals, logos, layout, structure) are protected by intellectual property law and remain the exclusive property of the Seller or its partners. Any reproduction, representation or exploitation, total or partial, without prior authorization is prohibited.
Article 11 — Personal Data
Personal data collected as part of the order is processed in accordance with the Site's Privacy Policy, accessible from the footer.
Article 12 — Consumer Mediation
In accordance with article L. 616-1 of the Consumer Code, in case of a dispute not resolved directly with customer service, the Customer can use a consumer mediator free of charge. Article 13 — Applicable Law and Disputes
